If you buy machines with telematics devices such as MyInsights, data concerning the machine, its condition, and its operation is being transmitted to TMH to better serve you and to improve upon our products and services. This Privacy Statement supplements the information contained in our general Privacy Policy published on our website at www.toyotaforklift.com, including the California Privacy Statement referenced therein (collectively, the “General Privacy Policy”). In the event of conflict between this Privacy Statement and the General Privacy Policy (or any privacy statement referenced therein), this Privacy Statement shall prevail with respect to the telematics information described herein.
Information We Collect
Telematics devices transmit information about the machine, including their condition and operational data.
This “telematics information” may include, but is not limited to:
- Equipment model number
- Equipment serial number
- Equipment location
- Equipment performance
- Diagnostic data
- Energy usage
- Service meter units
- Software and hardware version numbers
While TMH cannot identify the owner or operator of a piece of equipment with this telematics information alone, we can make that determination when the telematics information is combined with other data as discussed below.
What We Do with the Information
TMH uses telematics information to operate and provide the MyInsights platform and other telematics data products and services. This information is also used to:
- Improve our products and services
- Develop statistical studies
- Understand performance issues
- Comply with regulations and laws and protect people and property
The telematics information also may be combined with other data that TMH has collected (e.g., customer order data) in order to better serve you. The telematics information may be used in combination with such customer-identifying information to:
- Provide analytics and usage data through the MyInsights platform and other telematics data products and services
- Fulfill Customer Support Agreements, perform maintenance and repairs, and deliver rental equipment or parts (telematics data may be required for these services)
- Monitor and manage equipment health and efficiency
- Respond to inquiries, comments and suggestions you may have about your equipment
- Market research
- Notify you of promotions and special offers by its partners, affiliates, dealers, subsidiaries and TMH
In each case, such customer-identifying information shall only be used in accordance with applicable laws.
Collection Method
The telematics devices are designed to collect telematics information. The telematics information may be transmitted automatically or manually to TMH. If you utilize a service in connection with transmission, please refer to the privacy statement and/or terms and conditions of your specific service as other data may be collected through that service.
Safeguards
We take appropriate and reasonable steps to protect the telematics information that we process, regardless of where the systems that we use to process telematics information are located. We do this through physical, electronic and procedural safeguards that are designed to protect the confidentiality, integrity and availability of the telematics information. TMH intends to treat your telematics information respectfully and lawfully.
Sharing Information
Your telematics information may be shared by TMH, its partners, affiliates, dealers, and subsidiaries, but we disclose information only to those with a legitimate business reason to access it. This includes third parties who process information on behalf of our partners, affiliates, dealers and subsidiaries. Additionally, telematics information may be made available to subsequent owners of the equipment.
Your Consent
By purchasing equipment with telematics devices, you consent to its collection and use as described in this Privacy Statement and our General Privacy Policy.
Opting-Out
You may opt-out of the collection and processing of telematics information as provided in the usage agreement between you and TMH regarding your use of the MyInsights platform, Global Telematics System, or other telematics product (the “Usage Agreement”) by contacting us using the contact information available at https://www.toyotaforklift.com/myinsights-legal. Opting out will result in the termination of your Usage Agreement. To the extent applicable, you may also exercise your right to opt-out of the sale or sharing of personal information as provided in the General Privacy Policy, provided that such opt-out may result in termination of your Usage Agreement. TMH may continue to use and process telematics information collected prior to any termination or opt-out.
Privacy Statement Changes
We reserve the right, at any time, to add to, change, update, or modify this Telematics Data Privacy Statement. We will attempt to notify you in the event the changes to this Privacy Statement are material and could potentially impact your rights. Nevertheless, you should periodically review the terms of this Privacy Statement to stay informed of any changes and ensure your continued agreement. Any such addition, change, update, or modification will be effective immediately upon posting on this website.
If you use a TMH product with an account provided by an organization and if your organization provides you with access to TMH products, your use of the products is subject to your organization's policies, if any. You should direct your privacy inquiries, including any requests to exercise your data protection rights or to opt-out of the collection or processing of personal information, to your organization’s privacy contact.
